Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and RISEnHaul, a division of R.I.S.E. Technologies ("Company," "we," "us," or "our"), governing your access to and use of the RISEnHaul website, services, and mobile applications (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.

Service Description

RISEnHaul provides a platform that connects buyers with vehicles, powersports equipment, and heavy machinery across state lines. Our services include:

• Sourcing underpriced, high-value vehicles and equipment
• Facilitating interstate transport of vehicles and equipment
• Managing transactions between buyers and sellers
• Providing delivery of purchased items

Account Registration

To use certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Payment Terms

For any purchases made through the Service, the following terms apply:

• All prices listed on the Service are in US dollars and do not include applicable taxes or delivery fees, which will be added to your total amount.
• Payment for vehicles or equipment is held in escrow until the buyer receives and approves the item.
• Delivery costs are calculated based on distance, vehicle size/type, and other relevant factors.
• We accept major credit cards, bank transfers, and electronic payments.
• All payment information is processed through secure, third-party payment processors.

Vehicle and Equipment Condition

RISEnHaul makes reasonable efforts to verify the condition and authenticity of vehicles and equipment listed on our Service. However:

• We do not guarantee the condition of any vehicle or equipment beyond what is disclosed in the listing.
• Buyers have the right to inspect items upon delivery before accepting them.
• If an item's condition significantly differs from its description, the buyer may reject the delivery, and payment will be refunded.
• We require sellers to disclose all known issues with vehicles or equipment.

Delivery and Transport

When using our transport services:

• Delivery timeframes are estimates and may vary based on distance, route conditions, and driver availability.
• Items are fully insured during transport.
• Buyers are responsible for ensuring adequate access for delivery vehicles at the delivery location.
• Buyers or their authorized representatives must be present at delivery to inspect and accept items.
• We reserve the right to charge additional fees for deliveries to remote locations or for special handling requirements.

User Conduct

You agree not to:

• Use the Service in any way that violates any applicable national, state, local, or international law or regulation.
• Use the Service to engage in any activity that is fraudulent, false, or misleading.
• Attempt to bypass any security measures of the Service.
• Use the Service in any manner that could disable, overburden, damage, or impair the Service.
• Use any robot, spider, or other automatic device to access the Service for any purpose.
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of RISEnHaul and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of RISEnHaul.

Limitation of Liability

In no event shall RISEnHaul, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service; and
• Unauthorized access, use, or alteration of your transmissions or content.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
